Even Tractors ("we," "us," or "our") is an online marketplace that connects local buyers and sellers of physical goods including farm equipment, household items, antiques, locally made products, and more. We are based in Kentucky and operate at www.eventractors.com.
By accessing or using Even Tractors you agree to these Terms of Service. If you do not agree, please do not use the platform.
You must be at least 18 years old to create an account or engage in any transaction on Even Tractors. By using the platform you represent that you meet this requirement.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and current information when creating your account and to update it as needed.
We reserve the right to suspend or terminate accounts that violate these terms or that we determine, in our sole discretion, are being used in a fraudulent or harmful manner.
Even Tractors is a marketplace platform only. We are not a party to any transaction between buyers and sellers. We do not own, inspect, verify, or warrant any items listed on the platform. All transactions are between the buyer and seller directly.
We are not responsible for the quality, safety, legality, or accuracy of any item listed, the ability of sellers to sell items, or the ability of buyers to pay for items.
When you purchase an item on Even Tractors you are entering into a binding agreement with the seller. Payment is processed securely through Stripe. By completing a purchase you agree to the seller's stated fulfillment and return policies.
Even Tractors does not guarantee refunds or returns. Any disputes regarding item condition, delivery, or fulfillment are between the buyer and seller. We encourage buyers to communicate directly with sellers and to review listings carefully before purchasing.
Sellers are responsible for accurately describing their items, setting fair prices, and fulfilling orders in a timely manner. By listing an item you represent that you have the right to sell it and that your listing is accurate and not misleading.
Even Tractors charges a 5% platform fee on each completed sale, deducted automatically from the seller's payout via Stripe Connect. Sellers must complete Stripe onboarding before receiving payouts.
Sellers set their own return and refund policies. Even Tractors is not responsible for enforcing seller policies or mediating disputes.
You may not use Even Tractors to list or sell illegal items, stolen goods, counterfeit products, firearms, controlled substances, or any item that violates applicable law. You may not use the platform to harass, defraud, or harm other users.
We reserve the right to remove any listing or user that we determine violates these terms or that we deem inappropriate for the platform.
You retain ownership of any content you post on Even Tractors, including photos and descriptions. By posting content you grant us a non-exclusive, royalty-free license to display that content on the platform for the purpose of operating the marketplace.
Even Tractors is provided "as is" without warranty of any kind. We do not warrant that the platform will be uninterrupted, error-free, or free of harmful components. We disclaim all warranties, express or implied, including warranties of merchantability and fitness for a particular purpose.
To the fullest extent permitted by law, Even Tractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the platform or any transaction conducted through it. Our total liability to you for any claim shall not exceed the platform fees collected from your account in the 12 months preceding the claim.
These Terms of Service are governed by the laws of the Commonwealth of Kentucky, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the courts of Kentucky.
We may update these terms from time to time. We will notify users of material changes by updating the date at the top of this page. Continued use of the platform after changes are posted constitutes your acceptance of the updated terms.
